1. Scope of application

1.1 These General Terms and Conditions (GTC) apply to you if you purchase a subscription (membership) on the digital platform "ellexx" from ellexx universe AG or visit the website www.ellexx.com (visitor:in), and to all other contractual relationships that you enter into with ellexx universe AG. Contractual relationships that you may enter into with one of our cooperation partners via the product page do not fall within the scope of these GTC.

1.2 ellexx universe AG operates the website www.ellexx.com, where you as a natural person and as a legal entity can purchase either a monthly or an annual Membership on the digital platform "ellexx" at ellexx universe AG.

1.3 In order to be able to purchase a Membership, you must be a natural person with full legal capacity (minimum age 18 years) or a legal entity registered in the commercial register. If you are under 18 years of age, you need the written consent of your legal guardian or legal representative to purchase a Membership.

1.4 As soon as you as a visitor:use the website www.ellexx.com, you agree to these GTC. Use is deemed to have occurred whenever you call up the www.ellexx.com websites. In order to acquire a membership of ellexx, you give your active agreement with these terms and conditions by clicking on the checkbox. As soon as you become a member, we will send you our Storyletter. You can unsubscribe at any time.

2. Scope of services

2.1 ellexx universe AG operates the platform www.ellexx.com, where you can subscribe to a Membership of "ellexx" or read the freely accessible information. ellexx universe AG is responsible for the content of the website. Excluded from this are the product pages that have been created together with our cooperation partners.

2.2 The copyrights and rights of use remain with ellexx universe AG at all times.

2.3 You are solely responsible for deciding whether you wish to subscribe to a membership with "ellexx" or whether you wish to enter into a contractual relationship with one of our cooperation partners.

2.4 If you choose to purchase a product from our partners, you acknowledge and accept that we may receive commissions, retrocessions, compensation or other benefits (third party compensation) from our partners in connection with the services provided to you. You waive any claims regarding such third party compensation and acknowledge that we may retain such compensation as compensation for our services.

2.5 If you purchase a Membership for "ellexx", you are entitled to the following benefits as a "Member".

ellexx universe AG donates part of the membership income to projects that empower women. Part of the profit is invested by ellexx universe AG as an angel investor in start-ups. However, this means that you as a member have neither a legal nor a factual claim to proof of this donation or investment. The ellexx universe AG is free to choose to whom it would like to allocate the amount to be donated or the investment. Recipients of such donations or investments do not acquire a legal claim to payment.

3. Payment, commissions and fees

3.1 You will be asked to provide your surname, first name and email address before making your Membership payment.

3.2 Your payment as a Member for a Membership will be made to the account of ellexx universe AG. Any transaction fees will be deducted from the payment. The fees depend on your chosen means of payment.

3.3 As a Member, you agree that ellexx universe AG may instruct independent third parties to collect a payment from you to a Swiss account. For this purpose, you will be forwarded to a payment provider via an electronic payment gateway.

3.4 The amounts paid in by you as a Member are at the free disposal of ellexx universe AG.

3.5. Membership costs CHF 131 per year or CHF 13 per month including VAT.

4. Term, termination and repayment

4.1 Subject to an express declaration that the Membership is not to be continued, the subscription or your Membership will be renewed automatically and without further notice for a further year, or the monthly subscription will be renewed automatically and without further notice for a further month. You must notify us electronically (by e-mail or via the membership portal) of the non-renewal of the membership no later than two (2) working days before the renewal of the subscription.

4.2 A refund of a Membership once redeemed is not possible.

5. Data use and data protection

The following data protection declaration is an integral part of these GTC.

6. Duties as a member

6.1 You are solely responsible for the content of your registration as a member and thus for the information you provide about yourself. You confirm that the information you provide is complete and true.

6.2 As a visitor or member, you are obliged to indemnify ellexx universe AG against any costs, claims, damages, losses or other demands that may arise from your registration or visit to the website www.ellexx.com or for any other reason.

7. Shop

7.1. In the e-shop you place an online order. The order is binding if you have agreed to the terms and conditions and pressed the "Order now" button. This creates a legally valid sales contract between you and ellexx. After receipt of your order you will receive an order confirmation by e-mail.

7.2. After the order confirmation, we will send you the ordered items to the delivery address you specified. External influences such as natural disasters, slower processes at delivery partners can extend the delivery period. If delivery of the goods fails despite repeated delivery attempts, ellexx can withdraw from the contract. Apparently erroneous errors in the delivery of goods are to be reported in accordance with OR Art. 6a and sent back to us.

7.3. Our offer in the e-shop is non-binding. As a rule, the items offered in the e-shop are available. If it is not possible to deliver one or more items due to a stock discrepancy, we will let you know as soon as possible. In this case, the fee paid will be refunded to you.

7.4. Our sales prices are ex warehouse and are given in Swiss francs, including statutory VAT and excluding shipping costs.

7.5. For orders in our e-shop, you can use the payment options specified there.

7.6. We only deliver to Switzerland. You as the buyer bear the shipping costs. We only charge you for the actual postage costs. These can be seen in the shopping cart at the end of the payment process. We reserve the right to commission other companies with delivery in addition to Swiss Post or to deliver orders ourselves; shipping costs are non-refundable. It is not possible to collect your own items. The ordered goods remain the property of ellexx until full payment has been made.

7.7. You can revoke the contract within 10 days after receipt of the goods with a description of the reason for the return by returning the goods. The return of the goods is at your own risk and expense. Only items that are unworn, undamaged and in perfect condition will be accepted. In particular, worn, soiled, damaged or bad-smelling products cannot be returned. If this is not the case, we reserve the right to assert claims for compensation. If the total amount has already been transferred to us, we will send you back the corresponding amount using the same means of payment. Shipping costs are non-refundable.

7.8. We ask you to check the delivered items immediately for correctness, completeness and integrity. Complaints about the scope of delivery, material defects, incorrect deliveries and quantity discrepancies are requested to be made in writing by e-mail to hello@ellexx.com within 5 working days of receipt of the goods. We will be happy to check the defect. If the defect is accepted, we will send you an identical replacement item if it is in stock. Otherwise the entire amount will be refunded to you. Our warranties for the purchased items are limited to the assurances of the respective manufacturer. If you handle the products improperly or have personally modified them, your right to claim defects expires.

8. Disclaimer

8.1. ellexx universe AG assumes no liability whatsoever with regard to the correctness, accuracy, topicality, reliability and completeness of the information. Liability claims against ellexx universe AG for material or immaterial damage resulting from access to, use or non-use of the published information, misuse of the connection or technical faults are excluded.

8.2. All offers are non-binding. The information shown on financial and insurance products does not constitute investment advice or any other personal advisory service and is aimed exclusively at people resident in Switzerland.

We retain the compensation we receive from our cooperation partners as remuneration for the marketing of services. This is how we finance our content. In return, you won't find any banners or flashing ads on our platform.

Your waiver of refund

In accordance with Article 2.4 of our General Terms and Conditions, you waive the reimbursement of distribution fees and other remuneration by third parties which we have received in the past and may receive in the future.

This is the maximum amount of distribution fees that we can receive:

ellexx Pillar 3a: With a bank fee of 0.48%, this is divided equally between Vontobel and us. We are therefore entitled to 0.24% for our cooperation with Vontobel.

Migros Bank ellexx Tracker Certificate: With a fee of 1.1%, the issuer (ZKB) receives 0.3%. The remaining 0.8% is divided equally between Migros Bank and us. We are therefore entitled to 0.4% for our cooperation with Migros Bank.

ellexx JUSTIS legal protection: CAP pays us 10% commission on the net premiums collected from the ellexx portfolio (subscription fees excl. 5% stamp duty), based on the total net subscription fees collected.

Independent asset management: ellexx receives between 20% and 50% of the fees received from the various advisory services.

1. Intermediary undertaking and class of insurance

ellexx universe AG, Gasometerstrasse 36, 8005 Zurich (elleXX), acts as a contractually bound agent of CAP Rechtsschutz-Versicherungsgesellschaft AG (CAP) as well as Groupe Mutuel Services AG and sells legal protection insurance and health insurance products online on its behalf.

2. Contractual relationship

CAP has an agreement with elleXX as a tied agent. elleXX is remunerated for each policy. Groupe Mutuel has an advertising partnership agreement with elleXX and is compensated for each insurance policy taken out.

3. Errors, negligence, incorrect information

In the event of errors, negligence or incorrect information in relation to the brokerage of insurance contracts, elleXX and CAP as well as Groupe Mutuel are liable within the scope of the statutory provisions.

4. Personal data

elleXX, CAP and Groupe Mutuel undertake to take all precautions to ensure compliance with the statutory data protection provisions. As an insurance company, CAP as well as Groupe Mutuel collect and process your relevant personal data in order to provide an insurance quote and to process your policy after purchase. Personal data is usually stored in electronic and/or paper form.
