The unequal distribution of wealth is a global problem. In many developing countries, women face legal barriers that prevent them from inheriting property.

Why does inheritance matter?

If widows and daughters cannot inherit the land left by their deceased husband or father, for example, they only have temporary rights to it. As a result, they are more likely to be affected by land conflicts, and also cannot sufficiently secure their livelihoods. The financial inequality of women increases when they are excluded from inheritance - they are less capable to invest, have fewer livelihoods, and less money to provide for their families.

An issue in Europe as well

Inequalities in inheritance rights can also be found here in Europe. Women do not necessarily inherit less than men. The gap is between rich and poor. Inheritance is primarily a matter of social background - those who have, will be given. But one major difference remains: Since women generally have fewer assets, the prospect of inheritance is of higher importance to them.

Conclusion: Women have lower income, lower pension, and live longer - an inheritance can therefore save them from poverty in old age.

Watch out when inheriting!

Inheritance law can have its pitfalls. With Muslim women (for instance, from Kosovo) or dual citizens, for example, from Italy, the question may arise as to which law is applicable. Depending on this, there may be consequences for the amount of the inheritance. In patchwork families, the partner can also be left empty-handed. A notarial inheritance contract can be very useful here.

With female farmers, the situation is not always easy: many farms are dependent on direct payments, which a female farmer can only continue to receive if she meets the legal requirements. In addition, it makes sense here that the testator determines the priority in continuation before death.

In principle, however, all women can run into financial difficulties when they inherit - even in Germany or Switzerland. It is true that women and men inherit approximately as often and the same amounts. However, since women usually outlive their husbands, many assume that as a wife she will inherit all of her husband's assets. In Switzerland, without a will or inheritance contract, the woman receives only half, and the man's descendants receive the other half.

If there is property or an own business, this may mean that it has to be sold if it is impossible to pay the other heirs and they do not agree on who should get or continue it.

New inheritance law brings more flexibility.

As of January 1, 2023, a new inheritance law will come into force in Switzerland. It increases the free quota that a testator is allowed to distribute and reduces the compulsory shares of spouses and descendants. By means of a will or inheritance contract, a larger inheritance quota can then be ascribed to the wife or for instance a lifelong right to use the family home.

In any case, it is worthwhile to think about this at the right time so you do not miss out on inheritance.
